Harris & Harris Text-to-Pay Recurring Text Message Program Terms and Conditions

These Harris & Harris Text-to-Pay Recurring Text Message Program Terms and Conditions (“Terms and Conditions”) and Harris & Harris’ Privacy Policy, available at http://www.harriscollect.com/privacy-policy/, govern the Program (as defined below).

Program Description:
Harris & Harris, Ltd. (which includes for the purpose of these Terms and Conditions its agents and service providers and may be referred to as “Harris & Harris” or “H&H”) provides periodic text message updates and requests to consumers related to debts being collected by H&H that consumers may presently owe or may owe in the future (the “Program”). By opting in and/or providing your phone number to H&H or its clients in connection with an existing debt, you agree to receive periodic text messages. Messages are sent on a recurring basis and message frequency may vary.

How to Opt-Out:
You may reply STOP to any text we send you to opt-out. Once you opt-out, we will cease sending you text messages unless you opt-in again. Opting out of text messages will not opt you out of other text messages you may have elected or will elect to receive from us through a different telephone number. You may also opt-out by texting QUIT, END, CANCEL, or UNSUBSCRIBE.

Settings Reminder
: This is a friendly reminder that H&H does not dictate how text messages display on your phone or device, as those are elected by the user in the hardware settings and selections. If your texts are set up to display on your phone’s lock screen or through banners or similar alerts, you can chose to disable this through your device.

Support/Help:
In case of questions, call (844)840-8062. You may also reply HELP to any text we send you to receive a text message with our name and a telephone number to which you may direct questions.

Supported Carriers:
Not all carriers may support our text message program.

Delivery:
We do not guarantee that you will receive any text messages under the Program. Circumstances beyond our control, including network issues, may result in your not receiving our text message. H&H is not liable for delayed or undelivered text messages.

Eligibility:
The Program is intended for use by U.S. residents who are at least 18 years of age.

Changes to Terms and Conditions:
We may revise, modify, or amend these Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to our website. You agree to review these Terms and Conditions periodically to ensure that you are aware of any changes.

Program Termination:
Harris & Harris reserves the right to modify or discontinue, temporarily or permanently, all or any part of the Program, with or without notice.

California:
The state Rosenthal Fair Debt Collection Practices Act and the federal Fair Debt Collection Practices Act require that, except under unusual circumstances, collectors may not contact you before 8 am or after 9 pm They may not harass you by using threats of violence or arrest or by using obscene language. Collectors may not use false or misleading statements or call you at work if they know or have reason to know that you may not receive personal calls at work. For the most part, collectors may not tell another person, other than your attorney or spouse, about your debt. Collectors may contact another person to confirm your location or enforce a judgment. Colorado:
FOR INFORMATION ABOUT THE COLORADO FAIR DEBT COLLECTION PRACTICES ACT, SEE www.coloradoattorneygeneral.gov/ca. A consumer has the right to request in writing that a debt collector or collection agency cease further communication with the consumer. A written request to cease communication will not prohibit the debt collector or collection agency from taking any other action authorized by law to collect the debt. Massachusetts:
NOTICE OF IMPORTANT RIGHTS: YOU HAVE THE RIGHT TO MAKE A WRITTEN OR ORAL REQUEST THAT TELEPHONE CALLS REGARDING YOUR DEBT NOT BE MADE TO YOU AT YOUR PLACE OF EMPLOYMENT. ANY SUCH ORAL REQUEST WILL BE VALID FOR ONLY TEN DAYS UNLESS YOU PROVIDE WRITTEN CONFIRMATION OF THE REQUEST POSTMARKED OR DELIVERED WITHIN SEVEN DAYS OF SUCH REQUEST. YOU MAY TERMINATE THIS REQUEST BY WRITING TO THE DEBT COLLECTOR.” Office Hours (CST): Monday–Thursday 8am–8pm, Friday 8am–5pm and Saturday 8am–12pm.

A translation and description of commonly-used debt collection terms is available in multiple languages on the Department of Consumer Affairs website, www.nyc.gov/dca. If you have limited-English proficiency or prefer to speak in a language other than English on telephone calls with our office, please provide your language preference and we will record it in our files.

We provide telephone translation services through a third-party vendor, Argo Translation. Please also note that our payment portal found at www.payharris.com, which allows users to pay certain accounts online, contains instructions in Spanish (El sitio web de pago www.payharris.com contiene instrucciones en Español).

North Carolina:

Tennessee:
This collection agency is licensed by the Collection Services Board of the Department of Commerce and Insurance.

Wisconsin:
This collection agency is licensed by the Division of Banking, in the Wisconsin Department of Financial Institutions, www.wdfi.org.

Electronic Payment Authorization:
By (1) calling Harris & Harris, Ltd. At (844)840-8062 or taking a call from us; (2) specifying the amounts and dates of payments you would like to make; (3) identifying the deposit account of yours you which to use for making payments; and (4) electronically signing this Authorization, you authorize us to initiate payments from your account in the amounts and on the dates that you specify. You also authorize us to resubmit any unsuccessful payment or correct any erroneous payment. You understand that your bank may charge a fee for any unsuccessful payment and that we have no liability for any such fee. You may cancel this Authorization by calling us at (844) 840-8062 or writing us at least three business days before you wish the cancelation to be effective. This Authorization is no way limits any right you may have under federal law to stop payment of a preauthorized electronic fund transfer by contacting your financial institution.
